PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE OR OUR SERVICES.

 By accessing or using the Radiant Care Pharmacy website located at (Radiantcarerx.com) (the “Site”) or any services provided by Radiant Care Pharmacy (“Radiant Care,” “we,” “us,” or “our”), including prescription dispensing, medication counseling, or other non-clinical services (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the Site or Services.

Radiant Care Pharmacy is a separate entity from partnered prescribing providers (“Partner Providers”), who are independent healthcare professionals responsible for evaluating your medical needs and issuing prescriptions. Radiant Care Pharmacy and Partner Providers are distinct legal entities, and each is solely responsible for its own actions, omissions, or errors in connection with the services they provide. By using the Site or Services, you acknowledge that Radiant Care Pharmacy and Partner Providers are separate entities, and you agree to hold each responsible only for their respective services.

By accessing or using the Site or Services, you agree to these Terms, as updated from time to time. These Terms incorporate our Privacy Policy and HIPAA Notice of Privacy Practices. We may revise these Terms at any time, and changes will be effective immediately upon posting on the Site unless otherwise stated. Your continued use of the Site or Services after such changes constitutes your acceptance of the revised Terms.

If you are using the Site or Services on behalf of another person (e.g., a minor or family member), you represent that you are legally authorized to act on their behalf and agree to these Terms on their behalf.

The information provided through the Site and Services is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Radiant Care Pharmacy does not provide medical advice or diagnoses. All medical evaluations, diagnoses, and prescriptions are provided by independent Partner Providers, who are solely responsible for their medical judgments and services.

ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTHCARE PROVIDER FOR ANY QUESTIONS REGARDING A MEDICAL CONDITION OR BEFORE STARTING OR ALTERING ANY TREATMENT. 

Radiant Care Pharmacy assumes no liability for any damages or injuries arising from the use of information, products, or services provided through the Site or Services.

Radiant Care Pharmacy provides pharmacy services, including dispensing prescriptions issued by Partner Providers, medication counseling, and related non-clinical services. These Services are not health insurance and are not intended as a substitute for health insurance. You may direct your prescription to any pharmacy of your choice by contacting us before completing your order.

Partner Providers, not Radiant Care Pharmacy, determine whether a prescription or treatment is appropriate. There is no guarantee that a prescription will be issued, as this decision lies solely within the professional judgment of the Partner Provider. Radiant Care Pharmacy is responsible only for accurately dispensing prescriptions as provided by Partner Providers and for related pharmacy services.

Radiant Care Pharmacy and Partner Providers are separate legal entities. Radiant Care Pharmacy is responsible solely for pharmacy-related services, such as dispensing medications and providing medication counseling. Partner Providers are responsible for medical evaluations, diagnoses, and prescribing decisions. Each entity is legally responsible for its own actions, errors, or omissions. By using the Services, you acknowledge and agree that:

• Radiant Care Pharmacy is not liable for any errors, omissions, or negligence by Partner Providers in their medical evaluations, diagnoses, or prescriptions.
• Partner Providers are not liable for any errors, omissions, or negligence by Radiant Care Pharmacy in dispensing medications or providing pharmacy services.
• You will address any claims or disputes related to medical services with the responsible Partner Provider and any claims related to pharmacy services with Radiant Care Pharmacy.

You must be 18 years or older to use the Site or Services. To access certain features, you may need to create an account, providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use. Radiant Care Pharmacy is not liable for any loss or damage resulting from your failure to protect your account.

If you use the Site or Services on behalf of a minor or family member, you are fully responsible for their compliance with these Terms.

All content on the Site, including text, graphics, logos, and software, is the property of Radiant Care Pharmacy or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from this content without our prior written consent. All trademarks and service marks displayed on the Site are the property of Radiant Care Pharmacy or their respective owners.

You agree to use the Site and Services in compliance with all applicable laws and these Terms. You will not:

• Attempt to gain unauthorized access to the Site or its systems.
• Use automated tools (e.g., robots, spiders) to collect data from the Site without permission.
• Upload or transmit viruses, malware, or other harmful content.
• Use the Site to solicit illegal activities or infringe on the rights of others.
• Provide false or misleading information or impersonate another individual.

We may terminate your access to the Site or Services at our discretion, without notice, for violating these Terms.

By using the Site or Services, you consent to receive electronic communications from us, including emails, texts, or notices posted on the Site, regarding prescriptions, pricing, or other Services-related information. You acknowledge that electronic communications may not be secure and could be accessed by unauthorized parties. To opt out of certain communications, contact us or follow the unsubscribe instructions in our communications. Some communications (e.g., billing or legal notices) cannot be opted out of.

Radiant Care Pharmacy provides estimated pricing for prescriptions at the time of your search, but prices are subject to change. If a price is incorrect, your sole remedy is to accept the correct price or cancel the transaction. You are responsible for all charges incurred, including phone or data charges from using the Site or Services. Payments are due at the time of service, and you authorize us to charge your chosen payment method for Services provided.

If you provide insurance information, we may submit claims to your insurer, but you remain responsible for any uncovered costs. Submission of claims does not waive our right to seek payment directly from you.

THE SITE AND SERVICES ARE PROVIDED “AS IS” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. 

Radiant Care Pharmacy does not warrant that the Site or Services will be uninterrupted, error-free, or free of viruses or other harmful components. We make no representations regarding the accuracy, completeness, or timeliness of information provided through the Site or Services. Your use of the Site and Services is at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RADIANT CARE PHARMACY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

Our total liability is limited to the greater of $100 or the amount you paid for the Services. Some jurisdictions do not allow the limitation of liability, so this limitation may not apply to you.

You agree to indemnify, defend, and hold harmless Radiant Care Pharmacy, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, misuse of the Site or Services, or violation of applicable laws. We reserve the right to assume the defense and control of any matter subject to indemnification by you.

Any dispute arising out of or relating to these Terms or the Services will be resolved through binding arbitration in Davie, Florida, administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. You waive the right to a jury trial or to participate in a class action unless you opt out of arbitration by sending written notice within 30 days of accepting these Terms. Arbitration will be conducted in Davie, Florida, unless otherwise agreed, and the arbitrator’s decision will be final and enforceable in any court of competent jurisdiction. Each party will bear its own costs, except that we will pay AAA fees for claims under $75,000 unless the arbitrator finds your claim frivolous.

This section does not apply to disputes involving intellectual property rights or small claims court actions. The Federal Arbitration Act governs this section.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws provisions. Any legal action not subject to arbitration will be brought in the state or federal courts located in Broward County, Florida.

If any provision of these Terms is found to be illegal or unenforceable, that provision will be severed, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy and HIPAA Notice of Privacy Practices, constitute the entire agreement between you and Radiant Care Pharmacy regarding the use of the Site and Services, superseding any prior agreements.

We may suspend or terminate your access to the Site or Services at any time, without notice, for any reason, including violation of these Terms. Provisions related to intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law will survive termination.

If you believe any content on the Site infringes your copyright, notify our designated agent  with the information required under the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(2)). We will respond promptly to remove or disable access to infringing material.

By using the Site or Services, you acknowledge that Radiant Care Pharmacy and Partner Providers are separate entities, each responsible for their own actions, and you agree to these Terms in their entirety.
